Residential Property Eviction Management

Fees:
Xpello works on a monthly fee fixed fee of R250 (Incl VAT) per month or R2 760.00 (Incl VAT) per year If a tenant needs to be evicted, no additional fees are payable whether the eviction is dealt with on an unopposed or opposed basis.
(Our approval of the application is subject to tenants' credit checks submitted during the application process)
For a nominal fee - whether you are at home or out of town – you have full access to our team of highly experienced legal specialists who will handle the entire eviction process from start to finish. There is no waiting period and the Xpello legal specialists attend court on your behalf. An eviction that goes to court can cost a landlord a large sum (average R 40 000 per case!), however at a low fixed fee Xpello will take care of this at no cost to you, if a problem arises with non-payment of your tenant.
Criteria:
We do not accept leases where the tenant is already in breach of contract or has defaulted in the past 4 months. New leases are subject to a credit check. View the Apply page for more information.
Process:

As soon as we receive notification from you that the tenant has defaulted, we start taking action.

We instruct attorneys that specialise in residential evictions which are governed by the Prevention of Illegal Evictions from Land and Unlawful Occupants of Land Act 1998 (“PIE Act”).

Due to how residential laws work, Xpello takes care of the eviction only, and not the collection of outstanding rental. However, we can refer you to a relevant attorney in our partner network, who can assist with this at a 15% discounted rate.
Duration:
It can take 16 - 24 weeks if the eviction needs to go through the court process. However, often Xpello is able to work with the tenant and get them to move out before it escalates to court, which means you are then able to place a tenant sooner to minimise further financial losses.
Commercial Property Eviction Management

Xpello works on a monthly fee fixed fee of R300.00 (Incl VAT) per month or R3 450.00 (Incl VAT) per year.
If a tenant needs to be evicted, no additional fees are payable whether the eviction is dealt with on an unopposed or opposed basis.

The worrying decline in economic growth and the resultant lack of market spend could result in a higher risk of defaulting tenants for landlords of commercial properties. Xpello’s unique solution guarantees a safeguard against costly evictions by handling the entire process from start to finish.
Criteria:
Our Commercial services are only available to commercial leases where the rental amount does not exceed R50 000.00 per month. We do not accept leases where the tenant is already in breach of contract or has defaulted in the past 4 months.
Process:

Commercial law is not governed by the PIE Act and is instead regulated by common law, specifically "Rei Vindicatio" - the legal action by which an owner is entitled to recover the property from the person in possession of it. Xpello will instruct attorneys to apply to the High Court for judgment that includes an order for all 3 items:

Duration:

Estate agents are prohibited from evicting tenants; however, it is in the interest of the industry that agents are made aware of the processes undertaken to ensure a speedy, fully legitimate eviction. Elize le Roux, MD of Xpello, is an acknowledged expert in the field of legal evictions and shares her knowledge in training sessions.
The purpose of the training sessions is to advise owners and estate agents on topics such as vetting prospective tenants, learning more about residential and commercial leases, and clarifying the law.

Does Xpello collect the rental?No, if you use the attorney on our panel to assist you with the collection they will give you a 15% discount on their fees.

Are Xpello’s fees towards the eviction capped?No, we pay for the whole eviction process whether it is opposed or unopposed, including all the sheriff’s fees during the process.

Are there any additional costs to obtain the eviction?No, not during the eviction process. Should the occupants fail to vacate the property voluntarily after obtaining the eviction order the Sheriff’s costs to remove the occupants from the property, will be for the owner’s account.

Is there a waiting period from date of registering the lease?No, there is no waiting period as long as the tenant has not defaulted in the past 4 months, or it is a new lease and the credit checks meet requirements.

Why will the owner need Xpello if proper vetting was done?Eviction orders are not being recorded at this stage. A person can have a good credit check and good references, but still be a possible eviction risk. We further cannot predict the future and the tenant’s circumstances may change.

My agent is managing the property why is Xpello necessary?An agent is not authorised to institute an eviction on behalf of an owner as the PIE Act only authorises an Owner and “the Person in charge”, which is not the standard Managing Agent. With Xpello we may proceed with the eviction without any delay.
